Nissen testified that he stabbed Brandon, but that Lotter fired the shots that killed all three victims. Had Teena Brandon been getting quality psychiatric care, they would have addressed her sex abuse trauma, her eating disorder, her OCD, her alcohol abuse, and only then suggest sex reassignment etc. Therefore, postconviction relief on this basis was properly denied without an evidentiary hearing. Lotter and Nissen, both of whom had already served time in the state penitentiary on other charges, had been involved in a variety of unhappy relationships, drank heavily, and had floated from job to job. Before Lotter's trial, Nissen was convicted in a separate trial of first degree murder in the death of Brandon and second degree murder in the deaths of Lambert and DeVine.
